Millions of motorists are at risk of encountering delays in receiving compensation for car finance following a legal dispute. Around 12.1 million unfair motor finance deals are set to receive compensation averaging £829 each. Consumer Voice is challenging the Financial Conduct Authority’s compensation scheme, raising concerns that it may leave many consumers financially disadvantaged.
The scheme is anticipated to result in compensation payouts of approximately £7.5 billion, a decrease from the initial estimate of £8.2 billion. Total costs, including administration, are expected to reach £9.1 billion. Consumer Voice is planning to request a review of the scheme through the upper tribunal, emphasizing the importance of accurately reflecting the harm suffered by drivers and ensuring appropriate compensatory interest.
Consumer Voice argues that the FCA’s current approach does not adequately address the grievances of affected consumers, potentially leaving many under-compensated. The group asserts that the scheme disproportionately favors lenders involved in the mis-selling scandal. Alex Neill, co-founder of Consumer Voice, emphasizes the need for fair redress to rectify the situation for affected motorists.
Despite objections from some consumer organizations, the FCA defends its scheme as the most efficient and equitable method for compensating consumers. The scheme covers car finance agreements made between April 6, 2007, and November 1, 2024, involving commission payments to brokers by the lender. Consumers may have been mis-sold if their agreements included certain characteristics not adequately disclosed to them.
The FCA has adjusted eligibility criteria for redress, excluding loans with low commissions or zero interest rates, resulting in fewer eligible drivers but higher compensation amounts. This move aims to streamline the process and ensure more substantial payouts for those affected.
