Every year, a significant number of estates go unclaimed. Currently, there are over 5,000 unclaimed estates spread throughout the United Kingdom as of February 2026.
With the average property price in the UK standing at £270,259 and a total of 5,472 such properties, the collective value of these unclaimed estates is estimated to be close to £1.5 billion.
Private wealth solicitors from the UK law firm Weightmans have investigated the surnames and regions in the UK with the highest count of unclaimed estates, along with the necessary actions to safeguard your estate from a similar fate.
Richard Bate, representing Weightmans, emphasized the importance of creating a will not only as a legal requirement but as a crucial aspect of financial well-being. Bate highlighted that without a clear will, individuals risk leaving their assets to the discretion of the courts, potentially leading to lengthy and stressful disputes among potential heirs.
Bate further added that proactive estate planning and utilizing available resources can significantly reduce the chances of estates becoming unclaimed. By ensuring that final wishes are well-documented and legally protected, individuals can secure their legacy and alleviate the burden on loved ones during challenging times.
Analysis of unclaimed estates revealed that certain surnames appear frequently, suggesting either a widespread presence in the population or a higher occurrence of unclaimed estates. The most common surnames included Smith (94), Jones (55), Brown (45), Williams (35), and Taylor (29).
Weightmans highlighted that drafting a will remains the most effective method to ensure proper distribution of one’s estate in accordance with personal wishes, particularly crucial for individuals with limited or no surviving family members to prevent the risk of estates going unclaimed and reverting to state ownership.
In a will, individuals have the liberty to specify beneficiaries who can extend beyond family members to include friends, life partners, charities, or other preferred organizations. This flexibility allows for precise allocation of assets, whether in specific items, fixed amounts, or percentages of the estate value, enabling individuals to support causes and individuals important to them.
By having a professionally drafted will, individuals can eliminate ambiguity regarding their intentions, providing clarity for loved ones and ensuring that estate administration aligns precisely with the individual’s wishes.
Ultimately, a well-prepared will not only safeguards one’s legacy but also offers reassurance to beneficiaries, guaranteeing that final wishes are honored without room for legal disputes.
