A young man from Nigeria, Gift Oladele, has been convicted of raping a 19-year-old woman in the woodlands of Wales. This incident occurred in September last year. Prior to this, Oladele was sentenced to two years in prison in December 2022 for falsely imprisoning a woman in Manchester.
Despite the Home Office ordering his deportation in 2023, Oladele successfully appealed the decision, which allowed him to commit the rape in Wales. The judge in the 2022 case noted Oladele’s concerning attitudes towards women and deemed him a dangerous offender due to his clever and manipulative nature.
After multiple legal proceedings, including an appeal to the Asylum and Immigration Tribunal, it was ruled that Oladele’s deportation would breach his human rights under Article 8 of the European Convention on Human Rights. The tribunal found that Oladele had established a private life in the UK, making deportation unfair.
Oladele’s situation was further complicated by his relationship with a partner in the UK and the lack of ties to Nigeria, where he had never been. Despite being labeled a foreign criminal, the judge argued that Oladele was socially and culturally integrated in the UK. The probation officer’s assessment also indicated a low risk of reoffending.
In the end, the judge determined that the deportation order was not proportionate under Article 8 of the ECHR. The Home Office expressed dismay over the case and emphasized their commitment to removing foreign nationals who commit crimes from the country. Oladele is awaiting sentencing for the rape.
